Iron Strong Muay Thai LLC - Waiver and Release of Liability Form

Please read this form carefully and be sure that you understand its contents before signing. This waiver and release of liability form (the "Waiver") is designed to protect Iron Strong Muay Thai Academy LLC, its instructors, staff, and affiliates from legal liability in the event of an injury or accident while participating in martial arts activities at Iron Strong Muay Thai LLC.

In consideration of being allowed to participate in martial arts and fitness activities at Iron Strong Muay Thai Academy LLC, I, the undersigned, agree to the following:

1. Assumption of Risk: I understand and acknowledge that participating in martial arts, fitness, and related activities involves inherent risks, including but not limited to the risk of injury. I voluntarily and willingly accept these risks and assume full responsibility for any injuries, damages, or losses that I may incur as a result of my participation in these activities.

2. Fitness and Health: I certify that I am physically and medically fit to participate in martial arts and fitness activities at Iron Strong Muay Thai Academy LLC. I am not aware of any medical conditions, injuries, or physical limitations that would prevent me from participating safely. I will inform the instructors or staff if my medical condition changes.

3. Waiver and Release: I release and discharge Iron Strong Muay Thai Academy LLC, its owners, instructors, staff, and affiliates from any and all liability, claims, demands, actions, or causes of action, both in law and in equity, arising out of or related to any injury, damage, or loss I may suffer while participating in martial arts activities at Iron Strong Muay Thai Academy LLC.

4. Indemnification: I agree to indemnify and hold harmless Iron Strong Muay Thai Academy LLC, its owners, instructors, staff, and affiliates from any and all liabilities, claims, demands, actions, or causes of action brought by third parties arising out of my participation in martial arts activities.

5. Photography and Likeness: I grant Iron Strong Muay Thai Academy LLC the right to use photographs and/or video recordings of me for promotional and marketing purposes without compensation.

6. Emergency Medical Treatment: In the event of a medical emergency, I authorize Iron Strong Muay Thai Academy LLC to seek and administer necessary medical treatment for me.

7. Legal Jurisdiction: I understand that this Waiver shall be governed by and construed in accordance with the laws of the state of Massachusetts, and any legal action or proceeding related to this Waiver shall be filed and adjudicated in the state or federal courts located within the state of Massachusetts.

8. Use of Facility and Memberships: By signing this agreement, I fully and completely comply with the terms and conditions hereof and the school's rules and regulations. Failure to comply with the school's rules and regulations is grounds for immediate suspension or termination of service. Suspension or termination shall not entitle the member to a refund or credits for any amounts already paid or cancel any unpaid balance due. The failure or inability of member to use facility, classes, or services of business for any reason, except as otherwise provided herein does not relieve or suspend my obligation to make all payments required under this agreement on timely basis, nor entitle me to a refund or credit. Member understands and agrees that full payment of tuition is not guarantee or promise of advancement.

9. No Refund Policy: I understand that all payments, including membership fees, class fees, and any other payments made to Iron Strong Muay Thai LLC, are non-refundable. No refunds will be given for unused classes, missed sessions, or early termination of membership.

10. Membership Freeze Policy: I understand that memberships may only be frozen for a maximum of three (3) months. Requests for a membership freeze must be made in writing and approved by management. Memberships will automatically reactivate after the freeze period expires.

I HAVE READ AND UNDERSTOOD THIS WAIVER AND RELEASE OF LIABILITY FORM, AND I VOLUNTARILY SIGN IT WITH THE FULL INTENT OF BEING LEGALLY BOUND.
